Terms of Service

1. Acceptance of Terms

By accessing and using Votepoly's multi-tenant real-time voting platform ("Service"), you agree to be bound by these Terms of Service. Votepoly provides a white-label voting platform for organizations to host paid voting events. If you do not agree to these terms, please do not use our Service.

2. Service Description

Votepoly is a multi-tenant platform that enables organizations ("Tenants") to host real-time voting events. The Service provides:

  • White-label voting platform with customizable branding
  • Real-time vote processing and live leaderboards
  • Multiple payment method support (QRIS, Virtual Accounts, Credit/Debit Cards)
  • Administrative dashboard for event management
  • Analytics and reporting tools
  • Live vote announcements and notifications

3. User Types and Eligibility

Voters (Public Users)

To participate in voting, you must:

  • Be at least 13 years of age
  • Complete the payment process for each vote
  • Provide required contact information as determined by the event organizer
  • Comply with all voting rules and regulations

Tenant Administrators

Organizations hosting events must:

  • Be a registered legal entity or authorized representative
  • Accept responsibility for their event's compliance with applicable laws
  • Manage contestant data and voting configurations responsibly
  • Honor the pricing and terms set within their event

4. Voting Rules

By participating in the voting process, you agree to:

  • Cast votes based on your genuine preference
  • Not engage in any fraudulent voting activities
  • Not use automated systems or bots to cast votes
  • Accept that vote prices are set by individual event organizers and may vary per event
  • Understand that votes are final and cannot be changed or refunded once payment is confirmed
  • Accept that your vote data (including IP address) may be collected for fraud prevention

5. Payment Terms

All payments are processed through Votepoly's secure payment gateway partner, Xendit. The following payment terms apply:

For Voters:

  • Multiple payment methods supported: QRIS, Virtual Accounts (BNI, BCA, Mandiri, etc.), Credit/Debit Cards, and AMEX
  • Payment must be completed within the specified time limit (varies by payment method)
  • Minimum transaction amounts apply: IDR 10,000 for Virtual Accounts, IDR 5,000 for Credit/Debit Cards
  • All payments are final and non-refundable once confirmed
  • Failed or expired payments will result in vote cancellation
  • Processing fees may be charged to voters depending on event organizer settings

Processing Fees:

  • QRIS: 0.7% (VAT included)
  • Virtual Account: IDR 4,440 flat fee (VAT included)
  • Credit/Debit Card: 2.9% + IDR 2,000 + 11% VAT
  • AMEX Card: 3.9% + IDR 2,000 (no VAT)
  • Event organizers may choose to absorb these fees or pass them to voters

For Tenant Organizations:

  • No subscription fees or upfront costs to host events
  • Revenue sharing model applies: Gross revenue minus processing fees = Net revenue
  • Platform takes a percentage of net revenue based on agreed revenue split
  • Tenants receive detailed reconciliation and invoice documents
  • Payment settlement terms will be agreed upon separately

6. Tenant Responsibilities

Organizations hosting events on Votepoly are responsible for:

  • Setting appropriate vote pricing within reasonable limits
  • Managing contestant information and event configurations
  • Complying with all applicable laws regarding contests, raffles, or voting events
  • Handling disputes with voters regarding their specific event
  • Protecting confidential data accessed through the admin dashboard
  • Not using the platform for illegal, fraudulent, or misleading activities
  • Honoring the terms and conditions presented to their voters

7. User Conduct

All users agree not to:

  • Violate any applicable laws or regulations
  • Impersonate any person or entity
  • Interfere with or disrupt the Service or servers
  • Attempt to gain unauthorized access to any part of the Service
  • Use the Service for any illegal or unauthorized purpose
  • Harvest or collect information about other users without authorization
  • Manipulate votes through automated systems, bots, or fraudulent means
  • Reverse engineer or attempt to extract source code from the Service

8. Intellectual Property

All content on the Votepoly platform, including but not limited to text, graphics, logos, images, software, and source code, is the property of Votepoly or its licensors and is protected by Indonesian and international copyright laws.

Tenant organizations retain ownership of their uploaded content (contestant images, logos, branding materials) but grant Votepoly a license to display and process this content as necessary to provide the Service.

9. Data Collection and Privacy

Your use of our Service is governed by our Privacy Policy. We collect and process data as follows:

  • Voter information: Name, phone number, email (as required by event organizer)
  • Transaction data: Payment method, amount, timestamp, status
  • Technical data: IP addresses for fraud prevention and security
  • Real-time notifications: Vote announcements via Ably messaging service

Tenant administrators have access to voter data and analytics for their specific events. We employ industry-standard security measures to protect all user data.

10. Real-Time Features and Service Availability

Votepoly provides real-time voting features including live leaderboards, vote announcements, and notifications. While we strive for accurate real-time updates:

  • Real-time updates may be delayed based on event organizer settings
  • Leaderboard results may be frozen at strategic times by event organizers
  • Network conditions may affect the timeliness of real-time features
  • All confirmed votes are accurately recorded regardless of display delays

11. Disclaimers

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND. We specifically disclaim:

  • Any warranties of merchantability or fitness for a particular purpose
  • That the Service will be uninterrupted, timely, secure, or error-free
  • The accuracy or reliability of any information obtained through the Service
  • Responsibility for the conduct or decisions of tenant organizations
  • Liability for disputes between voters and event organizers
  • Guarantees regarding vote outcomes or contest results

12. Limitation of Liability

To the fullest extent permitted by law, Votepoly shall not be liable for any indirect, incidental, special, consequential, or punitive damages resulting from:

  • Your use of or inability to use the Service
  • Payment processing delays or failures by third-party payment providers
  • Actions or omissions of tenant organizations hosting events
  • Unauthorized access to or alteration of your data
  • Any damages exceeding the amount paid by you in the past 3 months

13. Indemnification

You agree to indemnify and hold harmless Votepoly, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your violation of these Terms of Service
  • Your use of the Service in violation of any law or regulation
  • Your violation of any rights of another party
  • For tenant organizations: disputes with voters or regulatory violations

14. Modifications to Service

We reserve the right to modify, suspend, or discontinue the Service (or any part thereof) at any time with or without notice. We shall not be liable to you or any third party for any modification, suspension, or discontinuance of the Service. Active voting events will be given reasonable notice when possible.

15. Account Termination

We reserve the right to suspend or terminate access to the Service for:

  • Violation of these Terms of Service
  • Fraudulent activity or voting manipulation
  • Non-payment or chargebacks by tenant organizations
  • Illegal activities or regulatory violations
  • Failure to respond to platform communications

Tenant organizations may export their data before termination. Confirmed votes and payments will be honored even after account termination.

16. Governing Law

These Terms of Service shall be governed by and construed in accordance with the laws of the Republic of Indonesia. Any disputes arising under these terms shall be subject to the exclusive jurisdiction of the courts of Jakarta, Indonesia.

17. Changes to Terms

We reserve the right to update these Terms of Service at any time. We will notify you of any material changes by posting the new Terms of Service on this page and updating the "Last Updated" date. For tenant organizations, we may also send email notifications of significant changes. Your continued use of the Service after any changes indicates your acceptance of the new terms.

18. Dispute Resolution

For voter disputes with specific events, please contact the event organizer directly. For platform-related issues:

  • Contact Votepoly support using the information below
  • We will attempt to resolve disputes through good faith negotiation
  • Payment disputes should be reported within 7 days of the transaction
  • Unresolved disputes will be subject to Indonesian arbitration or court proceedings
